Terms of Service

These terms govern use of OpenLine, a missed-call text-back service operated by Timothy Pehns, a sole proprietor based in Cape Coral, Florida. By using a business phone number connected to OpenLine, or by subscribing to the service as a business owner, you agree to these terms.

The service

OpenLine monitors a subscribing business's phone line and automatically sends a text message to callers whose calls go unanswered, then carries on a conversation intended to help schedule or qualify the caller's request. Conversations are ultimately handed off to the subscribing business.

No guarantee of outcome

OpenLine is a communication and lead-qualification tool. We do not guarantee that any conversation will result in a booked job, a sale, or any particular business outcome, and we are not a party to any agreement formed between a subscribing business and its customer.

Subscriber responsibilities

A subscribing business is responsible for ensuring it has the right to route its phone number's missed calls through OpenLine, for the accuracy of any information it provides about its services, and for complying with applicable telemarketing, consumer protection, and messaging laws in how it uses the resulting conversations.

Limitation of liability

To the maximum extent permitted by law, OpenLine's total liability for any claim arising from use of the service is limited to the amount paid by the subscribing business for the service in the month the claim arose. OpenLine is not liable for indirect, incidental, or consequential damages, including lost business or lost profits.

Termination

A subscribing business may cancel at any time; service continues through the end of the then-current billing period. We may suspend or terminate service for misuse, non-payment, or violation of these terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.

Changes

These terms may be updated from time to time. Continued use of the service after a change constitutes acceptance of the updated terms.
